1. Acceptance of Terms

By accessing or using L.A.I.D. AI (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. You must be at least 18 years old to create an account and use this Service.

2. Nature of the Service (Entertainment & Educational Use Only)

L.A.I.D. AI is an artificial intelligence tool designed to provide simulated dating strategy, logistics, and text messaging analysis. The advice, scripts, and strategies provided by the AI are generated by Large Language Models (LLMs) and are for entertainment and educational purposes only. They do not constitute professional psychological, behavioral, relationship counseling, or legal advice.

• AI Output Disclaimer and Limitations: We make no claim of ownership or copyright over the outputs generated by the AI ("Outputs"). The Service relies on third-party generative AI technology, which can occasionally produce inaccurate, inappropriate, unhelpful, or intended responses. We do not guarantee the accuracy, completeness, appropriateness, or effectiveness of any AI-generated Outputs. You accept all risks associated with following or acting upon AI-generated advice.
• Platform and API Dependency (Operational Disclosure): You acknowledge and agree that L.A.I.D. AI is a white-labeled application built on the Pickaxe Platform. Consequently, by agreeing to these Terms, you also acknowledge the underlying platform infrastructure is subject to the relevant technology sections of the Pickaxe Terms of Service, to the extent such terms apply to the generic technical use of the platform. We are not liable for any service interruptions, data loss, API failures, model downtime, or hallucinations originating from Pickaxe, Google's Gemini Enterprise Agent Platform, or other underlying third-party infrastructure providers.
• No Guarantees: We do not guarantee any specific real-world outcomes, including but not limited to matches, dates, success, or personal relationships. You are solely responsible for your own actions, conduct, and how you choose to apply the AI's suggestions in the real world.

3. Intellectual Property Rights & Content Ownership

• User Content (Inputs): As between you and L.A.I.D. AI, you retain all ownership rights in the text, data, and images you upload ("Input Content"). By uploading, you grant us a worldwide, non-exclusive, royalty-free license to access, store, and process Input Content strictly and only as necessary to provide the Service to you in accordance with our Privacy Policy.
• Our Platform: L.A.I.D. AI retains all rights, title, and interest in and to the Service, including the underlying application, website, code, logos, and branding. You are granted a limited, non-transferable license to access and use the Service for personal, non-commercial purposes during your subscription term.

4. User Conduct and Uploaded Content

The Service allows you to upload text and images (such as screenshots of dating profiles or text conversations) for the AI to analyze.

• Your Responsibility: You are solely responsible for the Input Content you upload to the Service.
• Privacy of Third Parties (Redaction Required): You explicitly agree **not** to upload images or text that contain sensitive Personally Identifiable Information (PII) of third parties, such as full names, phone numbers, home addresses, social media handles, or financial information. **You must redact, crop, or otherwise remove this information before uploading.**
• Prohibited Content: You explicitly agree not to upload any content that is illegal, defamatory, harassing, depicts minors, promotes violence, or constitutes non-consensual explicit media. Violating this rule will result in immediate account termination without a refund and potential reporting to local authorities.

5. Payments, Subscriptions, and Cancellations

• Billing: The Service is billed on a subscription basis. By providing payment information, you authorize our third-party payment processor (Stripe) to charge your account the recurring fee associated with your selected plan.
• Cancellations: You may cancel your subscription at any time via your account billing portal. Cancellation will stop all future billing, but you will retain access to the Service until the end of your current paid billing cycle.
• No Refunds: Due to the real-time server and AI API costs incurred the moment you use the Service, all sales are final and non-refundable. We do not provide refunds for partial subscription periods.

6. Limitation of Liability

To the maximum extent permitted by law, L.A.I.D. AI and its creators shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from: (1) your use of the Service or reliance on any AI-generated Outputs; (2) your interactions with third parties resulting from the Service; (3) account suspensions, bans, or adverse actions on third-party dating platforms (e.g., getting banned from Tinder, Bumble, Hinge, etc.); or (4) any failure, error, or data breach occurring within the systems of our third-party infrastructure providers (Pickaxe and Google's Gemini Enterprise Agent Platform).

In no event shall our total liability to you for all claims related to the Service exceed the total amount paid by you to us for the Service in the six (6) months immediately preceding the date on which the claim arose.

7. Dispute Resolution & Class Action Waiver

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be settled by binding arbitration administered by a nationally recognized arbitration association. Judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. **You waive your right to participate in a class-action lawsuit or class-wide arbitration.**

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of laws principles.

9. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any significant changes via a notification on the Service portal. Continued use of the Service after changes are published constitutes your acceptance of the new terms.
